Blue Wheel – Consumer Terms & Conditions

Welcome to Blue Wheel. Please read these Terms & Conditions (“Terms”) carefully before using our mobile application (“App”) or website. These Terms constitute a legally binding agreement between you (“Consumer”, “User”, “You”) and Blue Wheel Innovations Pvt. Ltd. (“Blue Wheel”, “We”, “Us”, or “Our”).

By downloading, accessing, or using Blue Wheel, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.

 

1. Introduction

  • Blue Wheel is a digital platform that acts solely as an aggregator to connect vehicle owners with independent third-party automobile service centers (“Service Centers” or “Partners”).

  • Blue Wheel does not own, operate, or control any Service Center. The responsibility for services, repairs, quality, and warranties lies entirely with the chosen Service Center.

  • Use of Blue Wheel is available only to persons who are competent to contract under the Indian Contract Act, 1872.

 

2. Services

  • Consumers may use Blue Wheel to:

    • Browse and compare available Service Centers.

    • View service offerings, prices (where available), and ratings.

    • Book services for cars and bikes including repairs, maintenance, pickup/drop, and doorstep service (if offered by the Service Center).

  • Blue Wheel’s role is limited to providing the technology platform for facilitating these interactions and bookings.

 

3. Bookings & Payments

  • Consumers may book services through the App. Once booked, the Service Center receives the booking details and may confirm, reschedule, or cancel.

  • Payments for services can be made:

    • Online through Razorpay, our authorized payment gateway.

    • Directly to the Service Center (if “Pay at Service Center” option is chosen, where available).

  • All payments are subject to Razorpay’s Terms of Service and RBI regulations.

  • Service charges, estimates, and final invoices are provided by the Service Center. Estimates shown in the App are indicative and may vary based on actual inspection.

  • Blue Wheel may levy additional charges including convenience fees, instant booking fees, or premium service charges where applicable.

 

4. User Responsibilities

By using Blue Wheel, you agree to:

  • Provide accurate and complete details of your vehicle, service requirements, and contact information.

  • Ensure timely cooperation with the Service Center, including vehicle handover, pickup, or availability at the doorstep (if applicable).

  • Refrain from misusing the platform (fraudulent bookings, fake information, misuse of offers).

  • Maintain proper conduct with Service Center staff and drivers assigned for pickup/drop.

 

5. Liability & Disclaimer

  • Blue Wheel is a facilitator and is not responsible for:

    • Delays in service delivery.

    • Damage to vehicle during servicing, repairs, or transportation.

    • Unsatisfactory services, warranty claims, or disputes.

  • Any dispute regarding service quality, damage, warranty, or charges must be addressed directly with the Service Center.

  • Blue Wheel shall not be liable for any indirect, incidental, or consequential damages arising from the use of our platform.

 

6. Intellectual Property

  • All content, logos, trademarks, and software in the App are the property of Blue Wheel.

  • Users may not copy, modify, distribute, or exploit any part of the App without prior written consent.

 

7. Termination

  • Blue Wheel reserves the right to suspend or terminate your account at its sole discretion in case of:

    • Misuse of the platform.

    • Fraudulent activities.

    • Breach of these Terms.

 

8. Modifications

  • Blue Wheel reserves the right to update, modify, or replace these Terms at any time.

  • Updates will be posted within the App or on our website. Continued use after changes constitutes acceptance of revised Terms.

 

9. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.

  • Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

Blue Wheel – Service Partner Terms & Conditions

Welcome to Blue Wheel Partner App. These Terms & Conditions (“Terms”) govern your use of the Blue Wheel platform as a registered automobile service provider (“Service Partner”, “You”). By registering on Blue Wheel, you acknowledge that you have read, understood, and agree to comply with these Terms.

 

1. Introduction

  • Blue Wheel is a digital platform operated by Blue Wheel Innovations Pvt. Ltd. that enables Service Partners to connect with vehicle owners (“Consumers”) for repair, maintenance, and related automobile services.

  • By registering with Blue Wheel, you agree to provide genuine, lawful, and quality vehicle services to Consumers through the platform.

  • These Terms apply in addition to any other specific agreements executed between Blue Wheel and you.

 

2. Service Listings

  • Partners are required to list accurate service offerings, prices, descriptions, and availability in the Partner App.

  • Service prices must be transparent and should not include hidden or misleading charges.

  • Misrepresentation of services, false listings, or fraudulent practices will result in suspension, penalties, or termination of your account.

  • Partners are solely responsible for updating their working hours, availability, and service categories on the platform.

 

3. Bookings & Payments

  • Consumers may book services through the Blue Wheel App. Bookings are to be honored as per details provided unless unavoidable circumstances arise.

  • Payments for services will be collected through Razorpay, Blue Wheel’s authorized payment gateway.

  • Blue Wheel will settle payments to the Partner’s registered bank account within the agreed settlement cycle.

  • Blue Wheel reserves the right to deduct commissions, applicable taxes, convenience charges, refunds, or penalties (if any) before releasing settlement amounts.

  • Any disputes regarding settlements must be raised with Blue Wheel within 7 business days of receiving the payment statement.

 

4. Partner Responsibilities

By registering with Blue Wheel, you agree to:

  • Deliver services with reasonable skill, care, and professionalism, ensuring industry-standard quality.

  • Maintain transparent communication with Consumers regarding service progress, costs, and timelines.

  • Provide timely updates within the Partner App (job start, job completion, pickup/drop updates, etc.).

  • Avoid unnecessary delays or overcharging beyond the agreed estimate unless Consumer consent is taken.

  • Ensure safe handling of vehicles, including pickup and drop (if offered).

 

5. Compliance & Legal Obligations

  • Partners must comply with all applicable laws, rules, and regulations including but not limited to:

    • Taxation laws (GST registration and compliance).

    • Local licensing and workshop permits.

    • Labor, safety, and environmental regulations.

  • Partners shall be solely responsible for remitting taxes and statutory dues arising from their services. Blue Wheel will not be liable for a Partner’s failure to comply with the law.

 

6. Customer Satisfaction & Ratings

  • Consumers may rate and review services. Blue Wheel may use these ratings to generate a Partner Health Score.

  • Poor ratings, repeated complaints, or customer dissatisfaction may result in reduced visibility, penalties, or account suspension.

  • Partners are encouraged to resolve disputes directly with Consumers in a professional manner.

 

7. Termination & Suspension

  • Blue Wheel reserves the right to suspend, limit, or permanently terminate a Partner’s access to the platform under the following conditions:

    • Fraudulent, misleading, or illegal practices.

    • Repeated complaints from Consumers.

    • Non-compliance with applicable laws or Blue Wheel’s policies.

    • Misuse of promotional offers, referrals, or incentives.

  • Upon termination, any pending settlements will be processed after deducting applicable charges, penalties, or refunds.

 

8. Intellectual Property

  • Blue Wheel retains ownership of all platform-related content, branding, and software.

  • Partners may use the platform only for legitimate service-related purposes. Unauthorized use, copying, or distribution is prohibited.

 

9. Limitation of Liability

  • Blue Wheel is only a facilitator and does not guarantee Consumer demand, booking volumes, or service outcomes.

  • Blue Wheel shall not be liable for indirect, incidental, or consequential damages arising out of your use of the platform.

  • The Partner is solely responsible for the service delivery, vehicle safety, and consumer satisfaction.

 

10. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India.

  • Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
